Elizabeth took her 13-month-old son, Casen Caine Case, with her as she went dumpster diving in her hometown in Limestone County, Alabama on October 4th,. She took her son and went out foraging on a Friday evening and when she returned home around 6 a.m. on Saturday, she left Casen in the car.
Temperatures flew over 90 degrees that day. Elizabeth's mother arrived at the home after 1 in the afternoon and found the young boy unresponsive in the sweltering heat. She brought him in the house and tried to revive him in the shower to no avail.
Case was initially charged with felony murder and aggravated child abuse, but a Limestone County grand jury returned the more serious charge after hearing evidence, District Attorney Brian Jones told The News Courier.
Case is being represented by Athens attorney Harlan Mitchell.
Case and the grandmother met first responders on U.S. 31. The infant was transported to Athens-Limestone Hospital, where he was pronounced dead, and Case was arrested shortly after.
At the time of her son's death, Case was free on bond on previous charges of third-degree burglary, receiving stolen property, second-degree theft, fraudulent use of a credit/debit card and two counts first-degree robbery.
